Privacy Policy

We are concerned about your right to privacy and we pledge to be responsible when gathering your personal information and to protect your privacy in every possible way. For the purposes of this Privacy Policy (“Privacy Policy”), “Personal Data” shall have the meaning as ascribed to it in the Personal Data Protection Act 2010 (“PDPA”). 

This Privacy Policy governs the website https://www.marcdata.com.my (the “Website” or the “Site”), operated by MARC Data Sdn Bhd ("MARC Data”). This Privacy Policy serves to explain MARC Data online information practices and how the information provided is collected and used in line with the PDPA, this Privacy Policy notice outlines our treatment and usage of Personal Data that we may receive from you. 

MARC Data reserves the right at any time to delete or change any aspect of the Privacy Policy. Such modifications shall be effective immediately upon notice thereof, which may be given by means of, including, but not limited to, posting on the Site, or by electronic or conventional mail, or by any other means. 

By using the Site after the date of any modification to the Privacy Policy, you are agreeing to the modification. If you do not agree to any modification made, you should stop and refrain from using the Website. You are advised to review the Privacy Policy periodically to be aware of such modifications. 

You hereby consent to the processing of your Personal Data in accordance with the provisions set out in this Privacy Policy.

PERSONAL DATA COLLECTED 

MARC Data may collect and process Personal Data that can be used to identify or contact clients. This information encompasses the following personal data: 

1. Personally identifiable information e.g. full name, date of birth, passport/identity card number 
2. Contact information e.g. address, contact address and phone number 
3. Payment information e.g. credit or debit card information, including the name of cardholder, card number, card issuing bank, card issuing country, card expiry date and banking account details 
4. Transaction information e.g. information relating to your purchase of products or services made on the Website 
5. Other information that can be used to identify or contact clients, which are necessary for the Purposes specified below. 

This information is generally requested when clients register on any of MARC Data website. Additionally, Personal Data that clients voluntarily provide may also be collected, for example, in emails to MARC Data websites. MARC Data may also collect your Personal Data from other sources, including but not limited to regulatory bodies, supervisory authority, credit bureaus, credit reporting agencies, financial crime reference agencies, and from other sources which the MARC Data has access to. Where we collect Personal Data from third parties we are careful to seek confirmation from those providing us with the information that it was acquired in accordance with the requirements of the PDPA, that they are entitled to provide it to us and that they are able to authorise us to use it for the purposes for which they are supplying it. 

All Personal Data requested by MARC Data is obligatory to be provided by you unless stated otherwise. Should you fail to provide the obligatory information requested by MARC Data, we would not be able to process your order and/or provide you with the products or services made on the Website.

PURPOSES FOR COLLECTING YOUR PERSONAL DATA 

The purposes (“Purposes”) for which your Personal Data are collected and processed depends on the nature of the relationship which you have with the MARC Data. Broadly, the Purposes may comprise part or all of the followings:- 

1. Providing you with any products and services you have subscribed or requested for; 
2. Billing purposes, filling-in customer orders, account management; 
3. To create, maintain, customize, and secure your account with us; 
4. Concluding, executing, and/or performing agreements and contracts with you;

Except as indicated herein, we will not sell, share, license, trade, or rent your Personal Data to others.

DISCLOSURE OF PERSONAL DATA 

Except as set out in this Privacy Policy, MARC Data will not provide your Personal Data to third parties without your permission. MARC Data will not sell, share, license, trade, or rent your Personal Data to any third party without your prior consent. Personal Data provided to third parties is limited to only that which is reasonably needed by third parties to carry out the Purposes specified above. MARC Data may disclose and transfer (whether in Malaysia or abroad) your Personal Data, to the extent necessary and permissible under the PDPA and/or any relevant laws and regulations, to the following third parties: 

1. any companies within the same group as MARC Data; 
2. companies, firms and/or organisations that are appointed by MARC Data to perform any of the Purposes; 
3. governmental and/or non-governmental bodies, authorities, agencies and/or departments and/or courts; 
4. MARC Data’s professional advisers, including but not limited to legal advisers, auditors, financial institutions, insurers, tax agents, or other professional firms or entities; 
5. MARC Data’s agents, service providers and/or consultants including but not limited to network operators or service providers, information technology service providers or data storage facility providers; 
6. customers, clients, principal agents, suppliers and/or vendors of MARC Data; or 
7. any other person and/or entity which MARC Data may think fit and appropriate. 

RETENTION PERIOD 

MARC Data will retain collected Personal Data for a period that is necessary to fulfil the Purposes outlined in this Privacy Policy. Such data will be deleted and/or destroyed in accordance with the requirements under the PDPA and/or any other relevant laws and/or regulations. 

ACCESSING OR CORRECTING YOUR INFORMATION 

You may request for access to, correction or deletion of your Personal Data, or limit the processing thereof (including personal data of others provided by you) at any time. Please note that MARC Data will take steps to verify the client’s identity before providing information or making corrections. INFORMATION SECURITY 

MARC Data has instituted industry standard measures to secure the information collected online to prevent unauthorised access, maintain data accuracy, and ensure the correct use of information. Despite this, clients should note that no site is 100% secure. Please notify MARC Data immediately if you believe your interaction with MARC has been compromised in any way. 

We may be obliged to disclose Personal Data we hold to law enforcement agencies. In such circumstances the use and security of that information is determined by the rules governing the relevant agency.
